Welcome to CSE Investing LK. These Terms of Service ("Terms") constitute a legal agreement between you ("User," "you," or "your") and CSE Investing LK ("we," "us," or "our") governing your use of our stock portfolio management platform and services.

Important: By creating an account or using our service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our service.

1. Service Description

CSE Investing LK provides a web-based portfolio management platform that allows users to:

Track stock holdings and transactions in the Colombo Stock Exchange (CSE)
Monitor stock prices and dividend information
Calculate realized and unrealized profits/losses
Manage cash balances and transaction history
Generate portfolio reports and analytics
Set up watchlists and stock monitoring alerts

Disclaimer: This service is a portfolio tracking tool only. We do NOT provide:

Stock trading or brokerage services
Financial advice or investment recommendations
Guaranteed returns or investment outcomes
Real-time market data feeds (unless explicitly stated)
Connection to your actual CDS or brokerage accounts

2. Eligibility & Account Registration

Eligibility Requirements

You must be at least 18 years of age
You must have the legal capacity to enter into binding contracts
You must provide accurate and complete information during registration
You must not be prohibited by law from using our services

Account Responsibilities

Accurate Information: Provide truthful and current information
Account Security: Maintain confidentiality of your password and account credentials
Unauthorized Use: Notify us immediately of any unauthorized access
Personal Use: Accounts are for individual use only; sharing is prohibited
One Account: Each user may have only one active account

3. Subscription & Payment Terms

Subscription Periods

Trial Period: Free access for a specified number of days (as configured by admin)
Paid Subscription: Annual subscription with specified fee (payable in advance)
Grace Period: Limited grace period may be provided after subscription expiry

Payment Terms

Payment Method: Bank transfer to designated account (details provided in app)
Verification: Upload payment slip for verification and account activation
Processing Time: Payments verified within 24-48 hours (business days)
Currency: Sri Lankan Rupees (LKR) unless otherwise specified
Non-Refundable: Subscription fees are generally non-refundable

Subscription Expiry

Upon subscription expiry, access to the platform may be restricted or terminated. Your data will be retained for a specified period, allowing you to renew and regain access.

Cancellation & Refunds

You may cancel your subscription at any time
No refunds for partial subscription periods unless required by law
You can delete your account and data at any time

4. User Obligations & Prohibited Conduct

You Agree NOT To:

Violate any applicable laws or regulations
Use the service for illegal or fraudulent activities
Attempt to gain unauthorized access to the system or other users' accounts
Distribute malware, viruses, or harmful code
Scrape, harvest, or extract data using automated tools
Reverse engineer, decompile, or disassemble the platform
Interfere with or disrupt the service or servers
Impersonate others or provide false information
Share your account credentials with others
Use the service to spam or harass

You Agree To:

Use the service only for lawful purposes
Maintain the security and confidentiality of your account
Provide accurate and truthful information
Report any security vulnerabilities responsibly
Comply with all applicable laws and these Terms

5. Data Accuracy & Investment Disclaimers

This platform does NOT provide financial, investment, or trading advice. All data is for informational and tracking purposes only. Consult qualified financial advisors before making investment decisions.

User-Entered Data

You are responsible for entering accurate transaction data. We do not verify the accuracy of your portfolio information. Calculation errors may occur if incorrect data is entered.

No Guarantee of Accuracy

While we strive for accuracy, we do not guarantee that calculations, stock prices, or dividend information are error-free or up-to-date. Always verify critical information with official sources.

Investment Risk

Stock market investments carry inherent risks. Past performance is not indicative of future results. You are solely responsible for your investment decisions and their outcomes.

No CDS Connection

This service has NO CONNECTION to your actual CDS (Central Depository System) account, brokerage accounts, or any financial institutions. It is a standalone tracking tool.

6. Intellectual Property Rights

Our Property

All content, features, functionality, code, design, graphics, and user interface of the platform are owned by CSE Investing LK and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works without our express written permission.

Your Data

You retain all rights to your portfolio data and personal information. By using our service, you grant us a limited license to process and store your data solely for the purpose of providing our services.

7. Service Availability & Modifications

Service Availability

We strive for 24/7 availability but do not guarantee uninterrupted service
Scheduled maintenance will be communicated in advance when possible
We are not liable for downtime, data loss, or service interruptions

Right to Modify

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with or without notice. We may also update features, pricing, and terms as needed.

8. Limitation of Liability

Liability Limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
We are not liable for investment losses, missed opportunities, or financial damages
We are not responsible for errors in calculations, data entry, or system malfunctions
Our total liability shall not exceed the amount you paid for the subscription in the past 12 months
We are not liable for indirect, incidental, consequential, or punitive damages
No security system is 100% secure; we cannot guarantee absolute data protection

9. Indemnification

You agree to indemnify, defend, and hold harmless CSE Investing LK, its developer, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the service
Violation of these Terms
Violation of any rights of third parties
Your investment decisions based on platform data

10. Account Termination

By You

You may terminate your account at any time through the account settings or by contacting us. Upon termination, your data will be deleted in accordance with our retention policy.

By Us

We reserve the right to suspend or terminate your account if:

You violate these Terms
Your subscription payment fails or is disputed
We detect fraudulent or abusive activity
Required by law or legal process
The service is discontinued

11. Governing Law & Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to conflict of law principles.

Dispute Resolution

In the event of any dispute, we encourage users to contact us first to seek an amicable resolution. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the platform.

Continued use of the service after changes constitutes acceptance of the updated Terms. If you do not agree with changes, you must discontinue use and close your account.

13. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and CSE Investing LK
Severability: If any provision is found unenforceable, remaining provisions remain in effect
No Waiver: Failure to enforce any right does not constitute a waiver
Assignment: You may not transfer your account; we may assign our rights
Force Majeure: We are not liable for delays due to circumstances beyond our control
